Terms of Service

1. The Service

FishMind AI provides fishing tools including bite-time predictions, spot discovery, weather information, an AI coach, catch logging, and community features. The Service is provided for personal, recreational use.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to use the Service) to create an account. By using the Service, you represent that you meet this requirement.

3. Accounts

• You are responsible for keeping your account credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• One person or entity may not operate multiple accounts in a way that circumvents the Service’s rules.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Post content that is illegal, infringing, harassing, hateful, or that you don’t have the right to share.
• Upload content that contains the precise location of private property in a way that could harm its owner.
• Attempt to access, disrupt, or reverse-engineer the Service, its systems, or its APIs.
• Scrape, spam, overload, or otherwise abuse the Service or other users.
• Use the Service in a way that could damage real-world environments or violate local fishing laws and regulations.

5. Your content

• You own your content. Content you post (such as catch logs, photos, spots, and comments) remains yours.
• License to us. You grant FishMind AI a worldwide, non-exclusive, royalty-free license to host, store, and display your content within the Service, to the extent necessary to operate the features you use (including your chosen privacy settings and the leaderboard).
• Your responsibility. You are responsible for the content you post and for ensuring you have the rights to share it, including any people depicted in photos.

6. AI features

AI-generated content (coaching advice, species suggestions, forecasts) is produced by third-party AI models and may be incorrect, incomplete, or unhelpful. It is provided for general informational purposes only and is not professional advice. Do not rely solely on AI output for safety, navigation, or decisions that could affect your wellbeing.

7. Subscriptions & purchases

• Paid features are sold through Apple In-App Purchase. Apple’s terms and your Apple account terms govern the purchase and billing of subscriptions.
• Subscriptions may auto-renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store / Apple ID settings.
• We may offer a free trial (for example, a 7-day trial). Trials convert to a paid subscription per the terms shown at purchase unless canceled.
• Refunds are handled by Apple according to its policies; we do not process payments or issue refunds directly.

8. Third-party services

The Service integrates third-party providers for AI, weather, maps, sign-in, and payments. Their terms and privacy practices apply to your use of those services. We are not responsible for the practices of third parties.

9. Intellectual property

The Service — including its design, features, branding, and the FishMind AI name and logo — is owned by FishMind AI and protected by intellectual-property laws. These Terms don’t grant you any right to use our trademarks or proprietary content except as needed to use the Service.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind. We don’t guarantee that predictions, scores, weather, maps, or AI outputs are accurate, complete, or reliable, or that the Service will be uninterrupted or error-free. You use it at your own risk.

11. Limitation of liability

To the maximum extent permitted by law, FishMind AI and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, catches, or profits, arising out of or related to the Service — even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold FishMind AI harmless from claims, damages, and expenses arising from your content or your violation of these Terms or the rights of others.

13. Termination

You can stop using the Service and deactivate your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion, with or without notice.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. You and FishMind AI agree to try to resolve disputes informally first.

15. Changes to these Terms

We may revise these Terms from time to time. When we do, we’ll update the “Effective date” above and, for material changes, notify you in the app. Continued use after changes take effect means you accept the updated Terms.
